Syvax User Agreement

Welcome to Syvax!

Syvax is designed to give you full control over the content captured by your Syvax devices, including videos and photos. You have the authority to manage who can access your cameras and stored content. Our system offers various service plans that may include features such as remote viewing, motion detection alerts, automatic recording, digital pan and zoom, video storage, and support for multiple cameras. You can customize your privacy settings through your Syvax account to keep your content private or share it as you see fit. Premium plans may enhance these features or introduce new ones.

1. Age Requirement

You must be at least 18 years old to sign up for Syvax. By registering, you confirm that you meet this age requirement. Syvax does not knowingly collect personal information from individuals under 18, and we do not allow minors to register without parental consent. If we discover that we have collected information from someone under 18 without proper consent, we will delete it immediately.

2. Introduction

Syvax is operated by Shenzhen Hanyun Unlimited Network technology Co. By using:

Syvax devices and the personal video network (the “Syvax System”); Syvax websites, associated subscriptions, content services, accounts, streaming platforms, and other related web services (collectively, the “Syvax Services”).

3. Terms of Service

Your registration of the Syvax System and use of the Syvax Services are governed by these Terms. Any software included in the Syvax System is licensed to you, not sold. Nothing in this Agreement grants you ownership of Syvax.

Syvax reserves the right to modify these Terms at any time. Changes will be posted on the Syvax website, and your continued use of the Services after such changes constitutes your acceptance of the updated Terms. If you disagree with any changes, you may cancel your subscription as outlined in Section 13.

4. Registration Information

To register, you must provide accurate and complete information, including a valid email address. You certify that you are at least 18 years old and legally permitted to use the Syvax Services. Providing false or incomplete information may result in account termination.

Syvax respects your privacy and will handle your information in accordance with our Privacy Policy, which we encourage you to review regularly. By registering, you consent to the collection, storage, and use of your information as described in the Privacy Policy.

You are responsible for maintaining the confidentiality of your account password and for all activities under your account. Notify Syvax immediately of any unauthorized use or security breaches. Syvax is not liable for losses.

5. Third-Party Content

Syvax may integrate third-party content to enhance your experience. However, Syvax does not control or endorse such content, and your use of it is at your own risk. Unauthorized copying or distribution of third-party content may violate intellectual property laws, and Syvax reserves the right to terminate accounts of users who infringe such rights.

6. Changes to Services

Syvax may modify, add, or remove features of the Services at its discretion. If you are dissatisfied with significant changes, you may terminate your subscription and receive a pro-rated refund for unused services.

7. Service Eligibility

The Syvax Services require a broadband internet connection. Users must be a adult or be within the age range permitted by local law. Parental discretion is advised for minors, as the Services may include explicit content.

8. User Conduct

You are solely responsible for all content you upload, transmit, or share through the Syvax Services. Syvax does not guarantee the accuracy or quality of user-generated content and is not liable for any losses resulting from its use. You agree not to use the Services for illegal or harmful purposes.

9. Content Ownership

You retain ownership of the content you submit to Syvax. However, by using the Services, you grant Syvax the right to process, store, and maintain your content for security, archival, and legal purposes.

10. Internet and Data Charges

You are responsible for any charges related to your internet or data plan incurred while using the Syvax Services. Streaming and viewing videos may result in substantial data usage.

11. Use of Services

You may only access the Syvax Services with authorized Syvax devices. Tampering with or modifying your Syvax System is prohibited. You agree to receive all software updates sent by Syvax.

12. Termination

You may terminate your account at any time. Syvax reserves the right to terminate accounts for breaches of these Terms or misuse of the Services. Upon termination, unused subscription fees may be refunded on a pro-rated basis. Upon termination,you must cease all use of the System, and all licenses granted under this Agreement will expire.

13. Notices

Syvax may notify you of changes to these Terms via email, text, or updates to the Syvax website.

14. Intellectual Property

All software and intellectual property rights, titles, and interests related to the Syvax System (including software, firmware, documentation, and branding) are owned exclusively by Syvax or its licensors. Subject to this Agreement, we grants you a non-exclusive, non-transferable, revocable license to use the System solely for personal or business purposes as permitted herein. Unauthorized use, modification, or distribution of Syvax software is prohibited.

The license is limited to: Use with Syvax-approved hardware/software. No reverse engineering, decompilation, or disassembly of the System. No resale, sublicensing, or leasing of the System.

If you believe your copyright or intellectual property has been infringed, please provide Syvax with the necessary details. Syvax may terminate accounts of repeat infringers.

Syvax is not responsible for the content or availability of third-party websites linked through the Services. Use such links at your own risk.

17. International Use

You agree to comply with all local laws and export control laws (e.g., EAR, ITAR) and content when using the Syvax Services.

18. No Resale

You may not reproduce, sell, or exploit any portion of the Syvax Services for commercial purposes.

19. Indemnity

You agree to indemnify Syvax and its affiliates against any claims arising from your breach of these Terms or misuse of the Services.

To the maximum extent permitted by law: Liability for damages (direct, indirect, incidental, consequential) arising from use of the System is limited to the purchase price paid. Syvax is not liable for data loss, profit loss, or other indirect damages.

20. No Third-Party Beneficiaries

These Terms do not create any rights for third parties.

21. Limitation of Liability

Syvax is not liable for any loss or damage resulting from your use of the Services, except in cases of gross negligence or willful misconduct.

22. General Provisions

These Terms constitute the enntire agreement between you and Syvax. Any disputes will be resolved through consultation or legal proceedings as necessary. If any clause is invalid, the remainder of the Agreement stands.

23. General Information

Entire Agreement. These Terms constitute the entire agreement between you and Syvax and govern your use of the Syvax Services superseding any prior agreements between you and Syvax with respect to the Syvax Services. You may also be subject to additional terms and conditions that may apply when you use or purchase certain other Syvax Services, affiliate services, third-party content or third-party software.

Choice of Law. These Terms shall be governed by, and construed in accordance with, the laws of users’ country, without regard to principles of conflicts of law thereunder.

Dispute Resolution.

23.1 Any dispute, controversy or, claim or difference of any kind whatsoever arising out of, relating to or in connection with these Terms, including the existence, validity, interpretation, performance, breach or termination thereof, the validity, scope and enforceability of this arbitration provision and any dispute regarding no-contractual obligations arising out of or relating to it (each, a “Dispute”) shall be resolved at the first instance through consultation between the parties to such Dispute. Such consultation shall begin immediately after any party has delivered written notice to the other party(ies) to the Dispute requesting such consultation.

23.2 Any negotiation without results can be appealed to the law, and the result of the litigation will be the final ruling plan.

Waiver and Severability of Terms. The failure of Syvax to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision and the other provisions of these Terms remain in full force and effect.

No Right of Survivorship and Non-Transferability. You agree that your Syvax account is nontransferable and any rights to your Syvax ID or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

The section titles in these Terms are for convenience only and have no legal or contractual effect.

25. Additional Terms for Syvax Awareness Service

If you subscribe to the Syvax Awareness Service, additional terms apply, including activation, duration, and payment details. By using the service, you consent to the collection and analysis of data by the Syvax system.
